4. Processing of Takedown Notices

Upon receiving a valid DMCA takedown notice, SarkariNews24 will take the following steps:

• Acknowledge receipt of the notice within 48 hours.
• Promptly remove or disable access to the allegedly infringing material.
• Notify the content provider, member, or user who posted the material that it has been removed or disabled.
• Provide the content provider with a copy of the takedown notice and inform them of their right to file a counter-notification.

5. Counter-Notification

If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification with our Designated Agent. The counter-notification must contain the following:

• Your physical or electronic signature.
• Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material.
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts in New Delhi, India, and that you will accept service of process from the person who provided the original takedown notification or an agent of such person.

Upon receipt of a valid counter-notification, SarkariNews24 will forward it to the original complainant. If the original complainant does not file a court action seeking to restrain the content provider within 10 business days, SarkariNews24 will restore the removed material.

6. Repeat Infringer Policy

SarkariNews24 maintains a strict policy regarding repeat infringers in accordance with 17 U.S.C. § 512(i). We will, in appropriate circumstances, disable and/or terminate the accounts of users who are repeat infringers. A repeat infringer is any user who has been the subject of more than two valid DMCA takedown notices. SarkariNews24 reserves the right to terminate access for any user at its sole discretion, including users who have been subject to even a single takedown notice if the infringement is deemed egregious.

7. Good Faith and Misrepresentation

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and legal fees incurred by SarkariNews24 or any copyright owner or licensee who is injured by such misrepresentation.

8. Indian Information Technology Act, 2000

In addition to the DMCA provisions, SarkariNews24 complies with the Information Technology Act, 2000 of India, as amended by the Information Technology (Amendment) Act, 2008, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. Under Section 79 of the IT Act, SarkariNews24 operates as an intermediary and qualifies for safe harbour protection provided it exercises due diligence and complies with the provisions of the Act.

Upon receiving actual knowledge or being notified by the appropriate Government or its agency that any information, data, or communication link residing in or connected to a computer resource controlled by SarkariNews24 is being used to commit an unlawful act, we shall expeditiously remove or disable access to that material in accordance with Section 79(3)(b) of the IT Act.

9. Fair Use and Fair Dealing

SarkariNews24 recognises that certain uses of copyrighted material may qualify as fair use under U.S. copyright law (17 U.S.C. § 107) or fair dealing under Indian copyright law (Section 52 of the Indian Copyright Act, 1957). When reviewing takedown requests, we consider whether the use of the material may be protected under these doctrines, including use for news reporting, criticism, comment, education, and research purposes.
